Terms of Service

Plain-English summary
- Be 13+ and don't pretend to be someone else.
- You own what you post. By posting it on T&T you let us display it on the platform.
- Don't cheat in tournaments. Don't harass other anglers. Don't post illegal content.
- Marketplace deals are between you and the other angler — we don't verify sellers or process payments.
- We can suspend accounts that break these rules. You can delete yours whenever you want.
- We provide the platform “as-is” without warranties; our liability is capped at what you paid us in the last 12 months (often $0).
1. Acceptance
By creating an account or using troutandtrails.com, our mobile app, or any related Services (collectively, “Services”) operated by One Overland, LLC (“Trout & Trails,” “we,” “us”), you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the Services.
2. Eligibility
You must be at least 13 years old to use the Services (older if your jurisdiction sets a higher minimum digital consent age). If you're between 13 and the age of majority where you live, your parent or guardian must agree to these Terms on your behalf.
3. Accounts
You're responsible for keeping your password secure and for anything that happens under your account. Notify us at admin@oneoverland.com if you believe your account has been compromised. One account per person; don't share or transfer accounts.
4. Your content
You retain ownership of the content you post (text, photos, catches, comments, reviews, listings, wiki edits). You grant Trout & Trails a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and create derivative works of your content as needed to operate the Services — including the right to surface your posts on the public feed, in digest emails, and in shared previews.
You represent that you have all rights necessary to grant this license and that your content doesn't infringe anyone else's rights or violate any law.
5. Acceptable use
You agree not to:
- Cheat in tournaments (re-use old photos, falsify GPS or EXIF, log on behalf of others without disclosure, register multiple accounts to game leaderboards).
- Harass, threaten, dox, or sexually harass other anglers.
- Post illegal content, content that infringes IP rights, spam, malware, or sexually explicit material.
- Use the Services to break fish-and-wildlife laws, post poached catches, or coordinate other illegal activity.
- Scrape, reverse-engineer, or programmatically access the Services beyond what our public APIs allow.
- Impersonate Trout & Trails, another user, a TU chapter, a fly shop, or any other entity.
We can remove content, lock accounts, and ban users who break these rules. Tournament organizers can disqualify catches per the rules they publish.
6. Tournaments
Tournaments on Trout & Trails are run by chapters and individual organizers, not by us. We charge a flat $25 publish fee to make a tournament public; we take 0% of any entry fees the organizer charges. Entry fees flow directly to the organizer via Stripe Express.
Organizers are responsible for their tournament rules, prizes, eligibility, dispute resolution, and any required permits or licenses. Trout & Trails is not a party to disputes between anglers and organizers, but we can mediate spam / abuse complaints at our discretion.
Anglers who cancel a paid registration before fishing starts receive an automatic refund through Stripe. Once fishing starts, refunds are at the organizer's discretion.
7. Marketplace
The marketplace lets anglers list used gear for sale to other anglers. Listings are between buyer and seller; we don't verify identity, condition, ownership, or handle payments. Meet in public, inspect gear before paying, and use a payment method you trust. We may remove listings that violate these Terms but make no warranty about any item or seller.
8. Payments and subscriptions
Angler Pro is $7.99/month with a 30-day free trial. You can cancel anytime; access continues through the end of the current billing period. We don't refund partial months.
All payments are processed by Stripe; their terms apply to the payment transaction itself. Failed payments may result in temporary loss of Pro features until resolved.
9. Third-party content and links
The Services include third-party content (USGS gauge data, OSM map data, Recreation.gov campground data, etc.) and links to third-party sites. We don't control or endorse third-party content and aren't responsible for it.
10. Trademarks
“Trout & Trails,” “The Drift,” and our logos are trademarks of One Overland, LLC. Don't use them in a way that suggests endorsement without written permission.
11. Account termination
You can delete your account at any time from your profile page. We can suspend or terminate accounts that violate these Terms, harm other users, or expose us to legal risk. On termination, your content is removed per our Privacy Policy.
12. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS-IS” AND “AS-AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONE OVERLAND, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR IN CONNECTION WITH THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR $100 IF YOU'VE PAID US NOTHING).
14. Indemnification
You agree to defend, indemnify, and hold harmless One Overland, LLC from any claim arising out of your use of the Services, your content, or your violation of these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Arkansas, and you consent to their jurisdiction.
16. Changes
We may update these Terms occasionally. Material changes will be announced in the app and via email at least 14 days before they take effect. The “Effective” date at the top reflects the most recent update. Continuing to use the Services after that date means you accept the updated Terms.
